Staff Analysis of the Legislation

SB 322 amends O.C.G.A. Title 20 and Chapter 1 of Title 35, relating to postsecondary education and law enforcement officers, respectively. SB 322 creates a new code section, O.C.G.A. § 20-3-72.1, which states that any law enforcement of campus systems who receive allegations of rape shall immediately report that allegation, and all related information, to the local law enforcement agency with concurrent jurisdiction. Any person, who knowingly fails to make a report, shall be guilty of a misdemeanor. O.C.G.A. § 35-1-20 is also created, and requires any law enforcement agency to fully cooperate with any college or university in regards to the disciplinary investigation of a student accused of sexual assault.
