Staff Analysis of the Legislation

            HB 928 seeks to amend Chapter 11 of Title 16 of the O.C.G.A. relating to offenses against public order and safety.

            New Code Section 16-11-37.2 is added to elucidate the scenarios in which an individual commits the offense of religious intimidation when he or she maliciously and with specific intent to intimidate or harass another individual because of such individual’s religion. No individual shall be convicted as such on the uncorroborated testimony of the party to whom the threat is communicated. Upon conviction, the offending individual will be guilty of a felony and shall be punished by a fine of not more than $1,000 and/or imprisonment for 1-5 years.
