SB 94, also known as “Bou
Bou’s Law”, amends §17-5-2, by prohibiting the issuing and execution of search
warrants that contain a “no-knock” clause authorizing law enforcement officers
to enter a premises without giving an audible verbal notice of their presence.
Officers could only enter without knocking if established probable cause
indicates knocking would pose a significant and imminent danger to human life
or of evidence being destroyed. |
