Staff Analysis of the Legislation

SB 34 revises O.C.G.A. § 33-7-11, related to automobile liability and coverage. If the insurer refuses to pay any insured any loss and the liability policy within 60 days, the insurer shall be liable for: damages equal to the applicable policy limits of the judgement rendered against the uninsured motorist; and post judgement interest on the damages. The court in its discretion may hold the insurer liable to the insured for reasonable attorney's fees and expenses of litigation.
