Staff Analysis of the Legislation

SB 94 adds a new Chapter 20 to Title 17 of the O.C.G.A. New Code Section 17-20-2 requires law enforcement agencies to adopt written policies and minimum requirements for eye witness identification procedures by July 1, 2016. It attempts to codify the best practices principles taught to law enforcement, including: in a live lineup, have an individual who does not know the identity of the suspect conduct the procedure; instruct witnesses that the alleged perpetrator of the crime may or may not be in the live or photo lineup; compose live and photo lineups using fillers who resemble the witness¿s description of the perpetrator; and record the confidence statement of the witness. The bill provides for public disclosure and inspection of such policies.
