Staff Analysis of the Legislation

SUMMARY:  LC 33 5499S

This is a constitutional amendment to revise the purposes for which e-SPLOST funds can be used to include certain items of maintenance and operations expenditures, up to 50% of proceeds from the tax.  The category of educational programs and materials is being added but is limited to those uses specified in the statute.

The current version of the proposed amendment does not change the requirements of calling the referendum nor provisions on how funds are to be distributed between city and county school systems.

See HB 802 for the enabling legislation to implement this if it passes.

EFFECTIVE DATE:

January 1, 2015 if it passes both chambers with a 2/3 vote and is approved by the voters in November 2014.
