Staff Analysis of the Legislation

SUMMARY:  LC 34 4245ERS

This bill is a result of reports of people fraudulently receiving these exemptions.  It tightens and adds restrictions on who and what is eligible to receive the sales tax exemption on agricultural related purchases.

It removes ownership of land in conservation use for forestland as an automatic qualification for the exemptions.

It also requires the commissioner of agriculture to use certain designated criteria to determine eligibility for the exemptions and provides limits on exemption card issuance.

The new limitations should add revenue but there is no estimate of the amount.
