Staff Analysis of the Legislation

SUMMARY: This bill would amend Part 2 of Article 6 of Title 32 of the O.C.G.A. to require the installation of active warning devices following a collision at any unmarked railroad grade crossing.

 

REQUIREMENTS:

  • The crossing must meet requirements of
    • Regularly scheduled trains,
    • 100 or more vehicles cross daily or if a regular school bus crossing
    • An order of the commissioner
  • If order of the commissioner has not been acted upon in 6 months, train speeds would be limited to not more than 25 miles per hour until the signal is installed.
  • Costs would be borne equally by state, county (municipality, if applicable) and railroad sources, unless federal funds are available.
  • If county or city refuses to pay, the state would withhold funds.
  • If railroad does not respond appropriately, they could be fined $500-$1000 per day.
