Staff Analysis of the Legislation

SUMMARY:  This bill would amend Parts 5 and 7 of Article 1 of Chapter 11 of Title 15 of the O.C.G.A. to change provisions regarding zero tolerance policy on weapons in schools, to prohibit pre-hearing detentions and to change provisions regarding school safety zones.

REQUIREMENTS:

  • A child could not be detained prior to a hearing on the petition in juvenile court.
  • It would eliminate bringing a weapon to school as a felony, unless it is a second or subsequent adjudication, or if the weapon:
    • Is used in an assault, or
    • Is a firearm, dangerous weapon, or machine gun.
