SUMMARY: This bill would amend Chapter 37 of the O.C.G.A. to authorize a city to grant conservation easements.
REQUIREMENTS:
- If a city determines that a conservation easement would be of benefit to the city and its systems by:
- Retaining or protecting natural, scenic, or open-space values of real property;
- Assuring the availability of the property for agricultural, forest, recreational, or open-space use;
- Protecting natural resources;
- Maintaining or enhancing air or water quality; or
- Preserving the historical, architectural, archeological, or cultural aspects of the property;
the city could then sell or grant a conservation easement to the land holder, including to any of its property set aside for use as a park.
NOTE: Though such use may enhance the appearance or services of a city, it could further reduce the tax base for local governmental entities and school boards. |
