Staff Analysis of the Legislation

SUMMARY:  This bill would amend Title 50 in an effort to make state and local government programs, services, and activities more efficient and cheaper.

REQUIREMENTS:

  • An Advisory Council on Public-Private Partnerships would be established with a Director located in the office of the Governor under the supervision of the chief operating officer and chief financial officer to form the Office of Public-Private Partnerships.
  • The Advisory Council would serve only in an advisory capacity to the Director, COO and CFO within the Governor’s office and would consist of 5 members appointed by the Governor and 2 ex-officio members appointed by the Lt. Governor and Speaker.  The chair would be appointed by the Governor.
  • Duties of the Office would be expected to:
    • Identify programs, services and activities as candidates for partnership initiatives;
    • Review and comment on proposed partnerships, if asked;
    • Provide advice and technical assistance regarding planning, awarding and implementing partnerships; and
    • Provide an annual report
  • The Office would keep a list of all local and state programs, services and activities and evaluate if any are candidates for a partnership with a rationale for the designation as such.
  • The Director would include the list in the annual report, prioritized by increased efficiency, cost savings or other goals, as well of a listing of current and pending partnerships and an evaluation of their performance.
  • Every county, city and local school district would be encouraged to provide the Director by July 1, 2012 a list of all programs, services and activities that are carried out by their organizations with an evaluation of whether they might be candidates for partnerships.  These would be included in the Director’s annual report, just like the state programs.
  • State grants would be contingent on local entities participating in the activities listed in the bill and the approval of the Director.
  • Specific and lengthy details of what would have to be included in the grant proposals and subsequent implementation are contained in the bill.
