HR 1025 proposes an amendment to the Constitution that would include “statement of legislative intent” as something that the Governor must either accept or veto in the appropriations process. Where the statement of legislative intent declares that an appropriation is mandatory, the funds must be expended in the manner stated or vetoed. Appropriations which are vetoed would then go back into the general fund and not be subject to redirection.

This constitutional amendment comes to the House Floor under the Open Rule.

Chairman Ehrhart’s opinion of this legislation:

This measure would require that statements of intent must either be accepted by the Governor or vetoed. In the past, the Governor has redirected money and ignored statements of intent included in the budget passed by the General Assembly.
