HB 975 creates a new code section which prevents local governments from issuing backdated licenses, permits and other documents which affect areas no longer within their regulatory jurisdiction. Anything issued in this manner will be considered void. Also, the bill makes it a misdemeanor for any local officer/employee to knowingly issue these void permits.  This measure is designed to correct a problem being faced by some newly incorporated, annexed or deannexed areas.

This bill comes to the House Floor under the Open Rule.

Chairman Scott’s opinion of this legislation:

This bill prevents a local government from backdating permits that will affect newly incorporated areas, protecting newly incorporated areas’ right of self-determination.
