House Bill 1026

Chair's Name: Vance Smith

Committee: Transportation

House Sponsor: Vance Smith

HB 1026 deals with relocating utilities during road improvements. Under this bill, if the DOT notifies the utility in writing that the there will be an obstruction or interference with the road construction/maintenance, the utility will be exempt from other specific statutory requirements.

This bill comes to the House Floor under the Open Rule.

Chairman Smith’s opinion of this legislation:

Under current law, the DOT gives two 45 day notices for the removal and relocation of utilities in the way of projects.  This legislation will remove the need for the second notice and thus save time on DOT projects for improvements and maintenance.

This Legislation:

Reduces the Tax Burden on our Citizens because by saving time, project lengths can be shortened and thus reduce the amount of taxpayer dollars used for such projects.
