Chairman Cooper’s Opinion of the Legislation:

Under current law, a nursing home is forced to move within 3 miles of its current location. This legislation would allow the nursing homes to move within the county that they are currently located.  The legislation also allows nursing homes to split their nursing home in to separate facilities, as long as the patient care is not sacrificed, with out having to get a second CON.

Many of the nursing homes throughout the state are aging and now in many areas the state the 3 mile rule has nearly impossible.  By allowing the nursing homes to move within county, this allows the facilities to construct new buildings to better serve the patient base.

This bill comes to the House Floor under the Open Rule.
