Staff Analysis of the Legislation

A Utah Supreme Court ruling held that the Utah Labor Commission may not award attorney fees in workers’ compensation cases because it violates the separation of powers. This bill repeals the attorney fee provision and instead allows the Utah Labor Commission to award an “add-on fee” to cover representation expenses in certain circumstances.
