Staff Analysis of the Legislation

HB 94 requires law enforcement agencies to adopt a policy and implement training instructing law enforcement officers not to use a person's race or ethnicity as probably cause or reasonable suspicion to stop a vehicle. Except in cases of road blocks, law enforcement officers would be required to collect data on the driver and the stop whenever they pull over a vehicle. If the officer does not issue a citation or written warning, he or she must give the driver a card with his or her name, badge number and law enforcement agency.  The law enforcement agency must include any complaints filed against the officer as part of its personnel review or evaluation procedure.  Any officer who does not comply with the requirement to collect data on traffic stops would be required to undergo further training.
