HB 134 provides additional regulations on the EPD issuance of water withdrawal permits that result in the interbasin transfer of water. EPD will have to post a public notice of the proposed IBT on its Web site at least 30 days prior to issuing the IBT permit and shall receive public comment. The consumptive use, water development and conservation requirements, and state water plan factors from HB 111 would have to be met, but water systems applying for a permit of less than 1 million gallons per day would be granted some leeway (on the state water plan factors) if they are not already transferring more than 1 million gallons per day.
