Staff Analysis of the Legislation

Current Georgia law prohibits distilled spirit sales within 100 yards of churches and 200 yards of schools, and sales of malt beverages within 100 yards of schools.  HB 1066 requires that for any alcoholic beverage licenses issued on or after July 1, 2012, local governments (by ordinance) must measure that distance along a straight line from the property line of the tract on which the business is located to the property line of the tract of the church or school (along a straight line which describes the shortest distance between the two property lines, regardless of obstacles).  Existing, licensed businesses are grandfathered in for renewal purposes if that distance was measured differently.
