Staff Analysis of the Legislation

This legislation prohibits counties from requiring or requesting that an employee or an applicant for employment provide their user name or password for a social media account.  Similarly, the county may not request that the employee or applicant for employment show them their social media account.  There is an exception for when the county believes that the employee has used the social media account to violate law or county policy.  Violation of this provision requires the county to pay a civil penalty of $1,000 per violation, court costs and attorney's fees to the employee or applicant.
