Staff Analysis of the Legislation

This legislation prohibits questions about a job applicant's arrest and criminal history record until the first interview of the applicant.  Following the first interview, an employer may obtain criminal history record.

This legislation does not apply to positions that cannot be held by an individual with certain types of criminal convictions pursuant to federal or state law or regulation.  Additionally, this legislation does not apply to positions that require a standard fidelity bond for which a criminal conviction would disqualify an applicant.
