Staff Analysis of the Legislation

SB 55 revises O.C.G.A. § 51-1-20.3, relating to torts and civil liability. SB 55 allows for a person to be immune from civil liability for any property damaged from the forcible entry of a vehicle when they: determine that the vehicle is locked and no reasonable method for the minor to exit the vehicle; has a good faith belief that forcible entry is necessary to prevent imminent danger of suffering harm; has notified law enforcement; and notifies the owner of such vehicles of their contact information.
