Staff Analysis of the Legislation

SUMMARY:  LC 33 5203  Authorizes a local board to agree to interventions in lieu of school board member removal proceedings if a school system is in danger of losing accreditation due to governance issues.

REQUIREMENTS:

  • interventions are to be determined by the State Board
  • interventions may include
    • complete reconstitution of the school system administration which may include removal of personnel, appointing new administration, hiring new staff, and reapplying for employment by existing personnel
    • provision of a monitor, master, or management team, the powers of which to be defined by the State Board
    • continuation of an intensive student achievement improvement plan
    • complete restructuring of the system's governance arrangement and internal organization of the school system
    • a recall election for each of the local board members
  • if the board fails to comply with such intervention(s), the board shall be subject to removal as per current law

EFFECTIVE DATE:  Upon approval by the General Assembly and Governor and preclearance by the US Department of Justice.
