Staff Analysis of the Legislation

SUMMARY:  LC 33 5082  Permissive legislation authorizing a public or private school to stock a supply of auto-injectable epinephrine after aquiring a prescription.

 

REQUIREMENTS: 
  • authorized medical personnel may prescribe such medication and a pharmacist may dispense such medication to a public or private school
  • the school must designate an employee training in the possission and administration of the medication who will be responsible for the storage, maintenance, and distribution of the medication
  • such trained employee may provide the medication to a student or another employee if medically necessary; may administer the medication to a student or employee if medically necessary
  • such designated employee shall be immune from civil liability if the medication is administered in good faith and not an act of willful or wanton misconduct

EFFECTIVE DATE:  Upon approval by the General Assembly and Governor.
