Staff Analysis of the Legislation

SUMMARY:  A companion bill to senate bills on teacher rights, this bill would amend Subpart 2 of Part 6 of Article 6 of Chapter 2 of Title 20 of the O.C.G.A. to enact a teacher bill of rights and to require annual evaluations of principals and asst. principals by teachers.

REQUIREMENTS:

  • Board members and administrators would have to respect independent thought and constructive criticism from teachers;
  • Teachers would  have the right to associate (or not) with a professional organization without fear of reprisal [Different from SB 307]
  • Teachers could not be coerced, threatened or intimidated to change a student’s grade [different from SB 307]
  • Teachers would have the right to remove a disruptive student for a minimum of one day and administrators would be prohibited from questioning the teacher’s account in front of students;
  • Teachers would have the right to file a grievance about an evaluation;
  • Teachers would have the right to participate in an annual evaluation of each administrator at his or her school with complete confidentiality and anonymity, and the evaluations would be sent to the superintendent who would have to send copies of each evaluation to the LBOE members;
  • Teachers could not be discriminated against on the basis of race, gender, age, religion, nationality, disability, or exercise of the freedom of association [different from SB 307]
  • No teacher could be the object of capricious or arbitrary treatment [different from SB 307]
  • If a teacher transfers to another system, the receiving system would have to grant full credit of experience toward the system’s local supplement.
  • TOTY’s would have to be selected solely by popular vote of the faculty.
