Staff Analysis of the Legislation

SUMMARY:

            This bill would amend Article 5 of Chapter 3 of Title 47 of the O.C.G.A. to provide for creditable service for prior service in the Trial Judges and Solicitors Retirement Fund, up to 10 years of service that could be purchased.

 

REQUIREMENTS:

  • A member desiring such credit would have to pay employee contributions which would have been paid to TRS comparable to his/her salary at the time of application, plus interest.
  • No one would be eligible for such credit if he/she is entitled to receive a pension or annuity from any other public retirement system except social security.
  • All applications and payments must be made by December 31, 2010.

 

NOTES:

  • A judge’s contributions would be based on his/her current salary as a teacher, not on the salary earned for 10 years as a judge.
  • This appears to be a “sweetheart” bill.  Who knows a judge who is now a teacher?  There might be one or two in the state, maybe more at the college/university level.  Obviously, there is at least one.
