SUMMARY: This bill would amend Subpart 2 of Part 2 of Article 16 of chapter 2 of Title 20 to expand the definition of bullying, to allow reassignment to another school for separation from victim(s), to require immediate notification of law enforcement for an alleged physical assault or battery on a student, teacher or another school employee
REQUIREMENTS:
- Adds to the definition “intentional written, verbal or physical act that:”
- Results in physical harm to a person or another’s property;
- Substantially interferes with another’s education;
- Intimidates or threatens educational environment because of severity, persistency, or pervasiveness;
- Substantially disrupts orderly operation of school when occurs on or through school property (computers) or events
- Extends applicability to K-12 from 6-12;
- Allows assignment of student outside attendance area to separate from victim;
- Requires SBOE policy to include:
- Prohibition of bullying;
- Immediate reporting by teacher or other employee who has reasonable suspicion of bullying;
- Investigation by administration promptly to determine if bullying occurred;
- Identification of age appropriate range of consequences;
- Procedure for anyone with information to report bullying, anonymously if desired;
- Parent notification of both parties;
- Prohibition of retaliation for reporting.
- Requires immediate notification of law enforcement agency when a student allegedly commits physical assault or battery of student, teacher or school employee.
