SUMMARY: This bill would amend Part 2 of Article 6 of Title 32 of the O.C.G.A. to require the installation of active warning devices following a collision at any unmarked railroad grade crossing.
REQUIREMENTS:
- The crossing must meet requirements of
- Regularly scheduled trains,
- 100 or more vehicles cross daily or if a regular school bus crossing
- An order of the commissioner
- If order of the commissioner has not been acted upon in 6 months, train speeds would be limited to not more than 25 miles per hour until the signal is installed.
- Costs would be borne equally by state, county (municipality, if applicable) and railroad sources, unless federal funds are available.
- If county or city refuses to pay, the state would withhold funds.
- If railroad does not respond appropriately, they could be fined $500-$1000 per day.
